NYS Wage Parity Notices Due to Home Care Aides by October 1

October is quickly approaching, which means it is almost time for certain home care providers in New York State (NYS) to comply with the annual notification requirements of the Home Care Worker Wage Parity law.

This notification requirement applies to employers who meet both of the following criteria:

  • Employ home care aides who provide Medicaid-reimbursed work within New York City and Nassau, Suffolk and Westchester counties
  • Provide compensation through both a base wage and a supplemental benefit to meet minimum compensation rate requirements

Each year, these employers must provide home care aides with a notice that details the supplemental benefit portion of their compensation. The notices must be provided to employees by October 1 and comply with all NYS Department of Labor guidelines.

The required supplemental benefit rate is currently set at $3.22 per hour in the three counties and $4.09 in New York City.
